Report on the European small claims procedure

To look for good offers in other countries is a way for consumers to take advantage of the benefits of the internal market within the EU. Online shopping makes it even easier.

But sometimes things do not go as planned, and there can be delivery problems or problems with the ordered goods. And to avoid difficult and expensive court proceedings, EU wants to simplify for the consumers to assert their rights.

One solution is the European Small Claims Procedure, which was implemented January 1, 2009, and which can be used to solve cross-border disputes in cases of at most 2000 euro.

A new report from the ECC-Net shows, however, that this simple procedure is not used very often. This is mainly due to the fact that the judiciary do not know about the procedure, and this is something that the European Commission wants to change.
